These Terms of Service ("Terms") are a binding agreement between you and FluxAura Tech LLC ("FluxAura," "we," "us," or "our") governing your access to and use of fluxauratech.com (the "Site"). By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
You agree to use the Site only for lawful purposes. You will not: (a) violate any law or regulation; (b) interfere with or disrupt the Site or its security; (c) attempt to gain unauthorized access to any system or data; (d) scrape, harvest, or misuse data; or (e) use the Site to transmit harmful code or spam. We may suspend or terminate access to anyone who violates these Terms.
The Site and its content — including text, design, graphics, logos, code, and the FluxAura name and marks — are owned by or licensed to FluxAura and are protected by intellectual-property laws. You may not copy, reproduce, modify, distribute, or create derivative works from the Site without our prior written permission. Ownership of work we create for clients is addressed in the Client Services Agreement.
Any demonstration projects, sample sites, mockups, brand names, statistics, or imagery shown on the Site (including pages under "/demos") are illustrative concept builds created to showcase our capabilities. They do not represent real companies, real customers, or real performance results unless expressly stated, and should not be relied upon as such.
The Site may link to or rely on third-party websites and services (for example, payment processors, hosting, or analytics). We do not control and are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their terms.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of harmful components.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUXAURA AND ITS OWNERS, MEMBERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify, defend, and hold harmless FluxAura and its owners, members, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Site or your violation of these Terms.
Information on the Site, including package descriptions and prices, is for general information and does not constitute a binding offer. Quotes are confirmed in writing, and any project we perform is governed by the Client Services Agreement, which controls in the event of any conflict with these Terms regarding the services.
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You agree that any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Illinois, and you consent to their jurisdiction. Each party waives any right to a jury trial to the extent permitted by law.
We may update these Terms from time to time; the "Last updated" date reflects the current version, and continued use of the Site means you accept the changes. Questions: [email protected].
